Fatal Pedestrian Crosswalk Accident
“Caring, Trustworthy, and Capable”
“We were greeted at the door, escorted into the conference room, and Russ and Ken were there within moments—feeling for what was going on with general concern for her well-being. And that’s when I noticed that both of them were kind of teary-eyed. The nice thing that I noticed was that I could trust these guys. I could trust them. It just felt we were in good hands—in good, capable hands. Nobody could have handled this as good as they did.”
The Ewell Family’s Story
On February 8th, Macala was walking to school. She had just entered the crosswalk at 2700 West in Magna when she was struck by a car and thrown nearly 100 feet. The driver of the car was in a rush to get to work. Because of the snow on the passenger side of the windshield, she could not see Macala enter the crosswalk. Macala was transported by medical helicopter to the University of Utah Medical Center in critical condition with a traumatic brain injury. Macala fought hard for four months, but after contracting an infection in the hospital she passed away. She was fifteen years old.
The driver of the car that hit Macala was not insured. Macala’s parents were facing more than a million dollars worth of medical bills, and they didn’t know what to do. Macala’s father read Ken’s book, “The 7 Biggest Mistakes that Can Wreck Your Utah Accident Case,” and decided to give us a call. We were able to meet with them and negotiate with the insurance company and Macala’s doctors to ensure that Macala got the help that she needed during her four months in the hospital.
In the end, we were able to get the Ewell family a settlement that covered all of Macala’s medical expenses. Macala’s family was so surprised and relieved because they had expected to be left with millions of dollars of debt following Macala’s death. We were grateful to be able to give the Ewell family the help that they needed so they could grieve and heal after their daughter’s death without the fear of being responsible for paying off overwhelming debt.
Making a Difference
Reporter: “Holloway was hit at a crosswalk near 85th west and 27th south on February 8th while she was walking to school.”
Ewell Family: “You hear the world “Life-flight” and you automatically assume the worst. And it was. It was absolutely the worst.”
Reporter: “Holloway had been in a coma since February. Unified Police Department says there could possibly be charges. Unfortunately the medical bills are over a million dollars.”
Ewell Family: “So we arrived at the hospital. They put us in a room at the E.R. and told us to wait. She was being assessed. The doctor comes in and you know, she kind of goes over to prepare us for what we’re going to see. And I don’t care what you say, nothing can prepare you to see this. To walk in and see your child with wires and tubes and there’s no place to touch her. And we just sat there and looked at her. And it’s the most helpless feeling that you could ever imagine.”
Reporter: “A 15 year old girl who was hit back in February died this morning. An attorney for Macala Holloway’s family says the teen had been fighting to survive a traumatic brain injury, but after 4 months, she passed away.”
Ewell Family: “I did a lot of extensive researching on different lawyers. I came across Christensen & Hymas. One of the biggest things that stood out was the book, “The 7 Biggest Mistakes That Can Wreck Your Accident Case” and I looked at that and thought, “that’s interesting.” So I started going through it. So we decided at that point that maybe we should contact the firm. We were greeted at the door, escorted into the conference room and Russ and Ken were there within moments, feeling for what was going on. With general concern for her well-being and that’s when I noticed that both of them were kind of teary-eyed. The nice thing that I thought was that I could trust these guys. I could trust them. It just felt we were in good hands—in good, capable hands. Nobody could have handled this as good as they did.”
